1. Any free services are only included with our Premier package with an executed non-cancellable 6 month listing agreement to sell the subject property of the client. If there is no sale of real estate there are no services offered for free and the Estate Sale choices are deferred to one of the other two estate sale packages offered.
2. Real Estate listing agreements, contracts and sales are executed through our affiliated real estate firm Cal Mutual Inc. a California corporation operating with the following licenses: BRE#01946651, NMLS# 1160889, dba; Cal Mutual, California Probate and Trust Real Estate Services.
3. Limits to the cost of the fees, labor, material and services paid by California Estate Sales or Cal Mutual are capped at a maximum of 1% of the property value listed on the Listing agreement of the subject real estate being sold. Any fees incurred or spent by California Estate Sales or Cal Mutual above the 1% maximum will be reimbursed by the seller at the close of escrow of the subject property sale. All invoices will be supplied to the client.
4. Estate sale profits are held by by California Estate Sales and given to the seller at close of escrow of the sale of the subject property.
If the property does not sell within the terms of the listing agreement then the profits of the Estate Sale are split 50%/50% between the Estate Sale administrator / seller and by California Estate Sales. If the 50% split does not cover all the fees incurred by by California Estate Sales the Estate Sale administrator / seller must reimburse the balance to California Estate Sales.
5. California Estate Sales reserves the right to deny services and be selective on the estate sales, services and real estate we chose to execute. Some estate sales and real estate sales may not fall within our ability, work load, scheduling, type of sale or scope of work.
